We have been waiting for changes in the Labor Code for a long time, but now a real revolutionary wave is passing through the regulations. First, there will be provisions on remote work, then additional leaves for parents related to the implementation of the EU directive on work-life balance, and trade unions are demanding that the so-called right to be off, i.e. turning off the phone, be quickly entered into the Code and business mail immediately after the end of the working day. However, according to the trade unions, the regulations on remote work, which have just been passed, require clarification, especially as regards the reimbursement of employees’ costs. Therefore, it cannot be ruled out that this part of the Labor Code will also be corrected soon.

Not all industries, due to the nature of their business, are able to introduce remote or hybrid work. Employers operating in these sectors must therefore look for attractive employee benefits that could offset this disadvantage. One of them may be a four-day working week, which, according to the ADP report “People at Work 2022: A Global Workforce View”, would be chosen by every fourth Pole (25.71%).

The provisions of the amended Labor Code regarding remote work have barely been passed by the Sejm, and their correction is already being discussed, which is primarily intended to make working from home or outside the company even more profitable for a home office employee. Since a kind of pathology in the popularization of remote work is the “softening” of the border between the end of work and the beginning of private life, trade unions demand that the provisions on the right to be off, which are only being discussed in the European Union, be decreed on the occasion of new remote working standards.

The first major amendment to the Labor Code in a long time, containing provisions on remote work, ends its legislative existence, and the new labor law norms should come into force on March 1, 2023.
