This represents a year-on-year increase of nearly 75%. from the amount of slightly over PLN 40 million that the fined entities should pay in 2021.

According to Business Insider Polska, Leszek Czarnecki paid the fine, although the KNF decision is not final.
— Penalties imposed on September 28 last year by Financial Supervision Commission on Leszek Czarnecki and on LC Corp for failure to comply with investor obligations were paid by the fined persons to the account of the KNF Office (PLN 20 million – Leszek Czarnecki; PLN 2.4 million – LC Corp). In accordance with the law, these funds were transferred to the Financial Education Fund, informs us Jacek Barszczewski, the supervisory spokesman.
It recalls that the Commission’s decisions were immediately enforceable. Which does not mean that the businessman accepted the reduction of his assets by over PLN 20 million after making the transfer.
— The decisions on the basis of which the KNF imposed fines on Leszek Czarnecki and LC Corp BV are not final. Both Leszek Czarnecki and LC Corp BV lodged complaints with the Provincial Administrative Court against the abovementioned administrative decisions Barszczewski adds.

Problems from years ago
The financial sanctions that fell on Czarnecki have their source in the events from over a decade ago. In 2011, a businessman from Wrocław sought permission to take over Allianz Bank Polska. For this purpose, he and LC Corp made commitments to ensure an appropriate level of the bank’s liquidity, its capital and capital adequacy ratios. The supervision gave the green light to the transaction, Czarnecki changed the name of the acquired company to Get Bank, and later transformed it into Getin Noble Bank. On 30 September last year, the latter was subjected to forced restructuring by the BFG.
Czarnecki was punished just before the decision BFGand the key in the justification published by the KNF is that “despite the deteriorating capital situation of the Bank (Getin Noble Bank – ed.) and the capital ratios remaining below the minimum regulatory levels for many months, until the date of the decision, i.e. September 28, 2022 r., Leszek Czarnecki did not take steps to improve the financial and capital situation of Getin Noble Bank“.
According to supervisory officials, this means that Leszek Czarnecki did not fulfill his commitment as an investor and did not recapitalize Getin or find an investor who could do it.
This was confirmed in an interview with Business Insider Polska by the president of BFG, Piotr Tomaszewski, who informed that before the start of the forced restructuring process, the businessman was asked if he would recapitalize Getin. The answer was negative.
